Terms of Service
These terms govern your use of palumb. They cover what the service is, how payment works through our Merchant of Record, your responsibilities for the data you send, and the usual legal protections for both sides.

1. The agreement
These Terms of Service ("Terms") govern your use of palumb, an EU-sovereign notification platform operated by [palumb operator — legal name], [registered address], [jurisdiction] ("palumb", "we", "us"). By creating an account or using the service you agree to these Terms. If you are using palumb on behalf of an organisation, you confirm you are authorised to bind it.
2. The service
palumb lets you define notification workflows in code that run on a managed, durable runtime, and deliver messages across channels (email, SMS, push, in-app) you connect. The self-hostable core is open source under the GNU AGPL-3.0; the client SDK and examples are MIT-licensed. We may improve, change or discontinue features, and will give reasonable notice of material changes.
3. Payments & Merchant of Record
Paid plans are sold through Creem (Armitage Labs OÜ, Estonia, EU), which acts as our Merchant of Record and the authorised reseller of palumb subscriptions. When you purchase a paid plan, your payment transaction is with Creem: Creem processes payment, issues invoices and collects any applicable VAT/sales tax. Creem's own terms apply to the purchase transaction. Fees are charged in advance per billing cycle and, except where required by law or stated otherwise, are non-refundable. Refunds and billing disputes are handled in accordance with Creem's policies; we will assist where we can.
4. Accounts & API keys
You are responsible for safeguarding your account credentials and API keys and for all activity under them. API keys are bearer credentials — treat them as secrets. Notify us promptly at hello@palumb.com if you suspect unauthorised use.
5. Your data & your responsibilities
You retain all rights to the data you send through palumb. As between you and palumb, you are the data controller for your subscribers' personal data and the notification content; palumb processes it on your behalf under our Data Processing Agreement (available on request). You are responsible for having a lawful basis to contact your subscribers, for honouring their opt-outs, and for the lawfulness of the content you send. You connect your own channel providers (email, SMS, push) under your own accounts.
6. Acceptable use
You may not use palumb to send unlawful, deceptive, infringing or harmful content, to send unsolicited bulk messages (spam) in violation of applicable law, to violate others' rights, or to attempt to disrupt, reverse-engineer or gain unauthorised access to the platform. We may suspend accounts that put the platform, its users or third parties at risk.
7. Availability
We aim for high availability and operate on durable infrastructure designed to retry and recover, but the service is provided on an "as available" basis. Any specific service-level commitments apply only if expressly agreed in a written plan or order. [SLA / uptime commitment — to be defined per plan.]
8. Intellectual property & open source
palumb and its trademarks remain ours. The open-source components are licensed under their respective licences (AGPL-3.0 for the core; MIT for the SDK and examples) — those licences govern your use of that code and prevail over these Terms to the extent of any conflict for that code.
9. Warranties & liability
To the maximum extent permitted by law, the service is provided "as is" without warranties of any kind, and palumb's aggregate liability arising out of or relating to the service is limited to the amounts you paid for the service in the [12] months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages. [Liability and warranty terms to be confirmed on legal review; mandatory consumer rights are unaffected.]
10. Term & termination
You may stop using palumb and cancel your subscription at any time; cancellation takes effect at the end of the current billing cycle. We may suspend or terminate access for material breach of these Terms or acceptable use. On termination, you can export your data for a reasonable period, after which it is deleted in line with our Privacy Policy.
11. Governing law
These Terms are governed by the laws of [governing law — jurisdiction], and the courts of [competent courts] have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
12. Changes to these Terms
We may update these Terms as the service evolves. We post the current version here with its "last updated" date and notify you of material changes where appropriate. Continued use after changes take effect constitutes acceptance.
